ITEM 8.01. OTHER EVENTS.
On September 22, 2006, Oscient Pharmaceuticals Corporation issued a press release announcing that it has received an approvable letter from the U.S. Food and Drug Administration (FDA) for the supplemental New Drug Application (sNDA) seeking approval for the five-day treatment of community-acquired pneumonia (CAP) of mild to moderate severity with FACTIVE® (gemifloxacin mesylate) tablets. A copy of the press release is filed as Exhibit 99.1 to this report and incorporated herein by reference.
