Lustberg adds that the penalties for possession of between half an ounce and five ounces of cocaine with intent to sell, distribute, or deliver are incarceration of up to 10 years in state prison and a fine of up to $150,000. If the person is allegedly caught with more than five ounces, they may face up to 20 years in state prison and up to a $500,000 fine.

In the article, attorney Lustberg also says that the aforementioned penalties are for first-time offenders. However, if someone has prior criminal convictions, the penalties for possessing cocaine with the intent to distribute are likely to be more severe. Additional penalties may also be imposed if the person is charged with distributing in a school zone or a public park.

According to the defense attorney, “As one of the toughest states against drug traffickers, a person convicted of distribution of cocaine can potentially face a 25-year mandatory minimum prison sentence with no option for early parole. If convicted of distributing cocaine to a minor or pregnant woman, the penalty is doubled. If convicted of distribution or possession of the said drug on or within 500 feet of a school, public housing, drug treatment facility, methadone clinic, or homeless shelter, additional penalties will also apply.”
